Terms of service
Thank you for using Boxpostale! These terms of service (the “Terms”) govern your access to and use of Boxpostale, Inc. (“we” or “our”) websites, applications, and services (the “Services”), so please carefully read them before using the Services. By using the Services you agree to be bound by these Terms. If you are using the Services on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these terms. In that case, “you” and “your” will refer to that organization. You may use the Services only in compliance with these Terms. You may use the Services only if you have the power to form a contract with Boxpostale, Inc. and are not barred under any applicable laws from doing so. The Services may continue to change over time as we refine and add more features. We may stop, suspend, or modify the Services at any time without prior notice to you. We may also remove any content from our Services at our discretion. You represent and warrant that you are responsible for complying with all known applicable export and import control laws and regulations in the order and receipt of merchandise under these Terms.
Services
Boxpostale, Inc. will provide you, after registration, with a shipping address in the United-States and France (along with a uniquely identifying suite number) at which you can have merchandise delivered prior to export. You may not however use your Boxpostale address as your place of representation for your residence or business.
Boxpostale, Inc. services consist of acting as an agent for consolidation and export purposes by receiving your merchandise, which will be sorted, packed, and in some cases consolidated. At your request, Boxpostale, Inc. arranges for export to your specified shipping address by an unaffiliated service provider, which acts as the freight forwarder and/or carrier for the shipment. Boxpostale, Inc. does not act as an indirect air carrier of property, but rather as an agent of the importer. All packages received by Boxpostale, Inc. may be opened for inspection. You are responsible for all import obligations in the country to which all packages will be sent. You also authorize Boxpostale, Inc. as your agent to authorize freight forwarder and/or carriers to conduct all necessary steps to perform customs clearance and entry. You accept that freight forwarders and/or carriers reserve the right to open and/or inspect every shipment tendered to them on your behalf.
You are responsible for informing the merchant that any goods purchased and sent to a Boxpostale address ultimately will be exported. It is your responsibility to ensure that the merchant provides the export classification of the merchandise and determines if any export licenses are required for the merchandise. You must also ensure that merchandise requiring an export license, or that is otherwise controlled for export, is not shipped to a Boxpostale address under any circusmstance.
Returns
We are happy to help with product returns as long as your package has not been exported. Most merchants accept returns and will refund the full cost of the product, but not shipping costs. Every store is different however, so be sure to check their return policy before you place your order. In the event you wish to return an item before it is exported, the return policy of the merchant will apply and you will be charged standard receiving and order preparation fees by Boxpostale, Inc. If the merchant does not provide you with a return label and you wish to purchase domestic postage from Boxpostale, Inc. you can simply place an ordinary shipment order with the original merchant as the recipient. We will do our best to accommodate any other special request you may have in order to properly prepare your return shipment. However, please note we unfortunately cannot handle returns after your package has been exported.
Cancellations
Shipment orders are not processed immediately after you place them. Which gives you a short window of time to cancel your order yourself before your order is processed. Cancellation requests can be made from our website. As a result, you will not be charged, and the parcels contained in your order will immediately revert to their "received" - in stock - status.
Refunds
If your payment has been processed and your order prepared, we may still be able to issue a refund and cancel the order if your package has not yet been handed to the carrier. Please contact us as soon as possible and we will do our best to accommodate your request. It is important to understand that our responsibility in handling your merchandise ends from the moment it is handed to the carrier. Publicly available tracking information provided by the carrier will serve as proof of pick-up/drop-off. After that, refunds may solely be issued in the event that an error was made in the preparation of your shipment. Refunds will not be issued under any other circumstance.
Termination
Though we would prefer you stay, you can stop using our Services any time. In the event you would like to permanently delete your account, please contact us and your request will be executed in a timely manner. If any Boxpostale address was previously assigned to you, you agree to not use it after your account has been terminated. We also reserve the right to suspend or end the Services at any time, with or without cause, and with or without notice.
Temporary Export Ownership
In order to ensure smooth export and import clearance, we act as the Exporter of Record for your shipments. To that effect, we assume full ownership of the goods from the moment they are received at our facility, until they are either (a) cleared for export by the origin country's Customs authorities or (b) handed to a carrier for delivery not requiring customs clearance (e.g. domestic delivery). Should any prohibited, restricted, or otherwise controlled commodity transit through our facilities, we reserve the right to void this mandate to the extent permissible by law. It is your responsibility to ensure that merchandise requiring an export license, or that is otherwise controlled for export, is not shipped to a Boxpostale address under any circumstance.
After we have assumed ownership of compliant merchandise, upon receipt at one of our facilities, it may be held in stock for up to 6 months. We reserve the right to dispose of any merchandise exceeding this storage period, at our discretion.
Property And Feedback
These terms do not grant you any right, title, or interest in the Services. While we appreciate it when users send us feedback, please be aware that we may use any feedback, comments, or suggestions you send us without any obligation to you. These Terms do not grant you any rights to use the Boxpostale, Inc. trademarks, logos, domain names, or other brand features.
Modifications
We may revise these Terms from time to time and the most current version will always be posted on our website. If a revision, in our sole discretion, is material we will notify you (for example via email to the email address associated with your account). By continuing to access or use the Services after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, please stop using the Services.
Governing Law And Dispute Resolution
You agree that all matters relating to your access to or use of the Services, including all disputes, will be governed by the laws of the United States and by the laws of the State of Delaware without regard to its conflicts of laws provisions. Any claim under these Terms must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. No recovery may be sought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and attorneys’ fees. In the event of any controversy or dispute between Boxpostale, Inc. and you arising out of or in connection with your use of the Services, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time (not to exceed ninety (90) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.
Limitation Of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BOXPOSTALE, INC., ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL (INCLUDING LOSS OF USE, BUSINESS, OR PROFITS) DAMAGES, REGARDLESS OF LEGAL THEORY, WHETHER OR NOT BOXPOSTALE, INC. HAS BEEN WARNED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

"AS IS" AND TO THE EXTENT PERMITTED BY LAW, IS PROVIDED WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, OR NON INFRINGEMENT. WHILE THE INFORMATION PROVIDED IS BELIEVED TO BE ACCURATE, IT MAY INCLUDE ERRORS OR INACCURACIES.
